Hey just a heads up. Stepto of Xbox LIVE Enforcement said anyone who does legitimately obtain a copy of Halo 3 ODST and decides to play it early on LIVE will NOT be banned nor will any action be taken against them.
They do however know who plays illegal copies (pirated) and are on modded consoles then you will be banned. But if you buy this game from that seller and win and play it early you are completely safe.

Yeah, if someone bought this game and played it, it wouldn’t be a problem, unless of course if the game the person is selling on Ebay is a pirate copy.

@Harry it probably is. I have the retail advertisement box for ODST that the store gave to me when I preorder a month ago. It’s indistinguishable from the real retail case.
I could easily download and place a pirated ODST on a printable DVD, make it look real and sell it for $200.00 other than the fact that it is illegal of course! But yea I would avoid these offers like the plauge!

@Zerghumper – a pirated copy would only work on a flashed Xbox 360 so that doesn’t make sense – i.e. the buyer will know it is pirated and easily get the seller in huge trouble.
